Hazleton Police Solve Home Invasion Cold Case with Arrest

From HPD;

On July 11, 2014 around 2am, HPD was dispatched to the area of the 100 block of North Fulton Court.  An individual called 911 to report that a man was beaten up and laying in the street.    Upon arrival numerous Hazleton Police Officers observed a male victim lying in the street with both hands tied behind with his back with cable wire.

The officers observed the male bleeding heavily from his face and mouth and immediately attempted to communicate with him. The male identified himself to the officers as officers inquired as to the circumstances.  The victim informed the officers that he was beaten and held hostage in his home.

The victim was transported to Lehigh Valley Hazleton Hospital and immediately life flighted to an area trauma center.

Corporal Walter Mazur interviewed the 911 caller who provided the initial information.

The caller informed Mazur that the caller heard an individual calling for help and went to the rear door of the residence, which afforded a clear vantage point of the area of Fulton Court between Oak and Hemlock Streets.  The caller stepped outside and observed three male subjects standing over the male victim who he had observed in the street and provided a description.

The caller stated that he witnessed three subjects standing over the male victim and witnessed one strike him in the head with a closed fist.  Shortly thereafter, the subjects took off running North on Fulton Court leaving the injured male victim in the middle of the roadway.

The victim provided a detailed account indicating the victim had been held hostage and beaten in his residence on Fulton Court.

Detective Sergeant David Rodick reviewed forensic evidence from the scene and the following actors were identified as XAVIER MIRANDA, JUAN JESUS ROSARIO and VISNEYDY MARTINEZ.

Hazleton Detective Division continued to investigate this crime and on May 27, 2019, Detective Sergeant David Rodick responded to the crime scene on Fulton Court in the furtherance of the investigation.

The investigation again revealed the victim was coerced at gunpoint into the residence, beaten and robbed.  Once inside the residence, the actors identified above began to physically beat the victim by punching, kicking and striking him with an object throughout the entire home.  The victims hands were bound behind his back as one of the actors restrained the victims arms and the other tied the victim with cable wire.  The victim was continuously beaten for dead and never left alone by the assailants.  The above actors made no efforts to conceal their identities or faces during the encounter.  The individuals were identified as JUAN JESUS ROSARIO and XAVIER MIRANDA both whom attempted to sexually assault and sodomize the victim during the crime.

During the criminal encounter, XAVIER MIRANDA utilized his cellphone and a short while later the victim heard a car pull in and park in the alley, outside of the home.  Moments later, a third, male voice was heard by the victim in the home.  XAVIER MIRANDA and JUAN JESUS ROSARIO were together beating the victim in the kitchen when the victim heard the voice of another person and footsteps running upstairs on the second floor of the home.  The investigation revealed that the third male inside the house was identified as VISNEDY MARTINEZ who allegedly stole the victims jewelry valued at $4500.

The victim then convinced MIRANDA AND ROSARIO that money was hidden inside of the car located in the garage and the victim was escorted from the main entry door of the home into the garage.  As the victim was being escorted out the home, XAVIER MIRANDA had a knife pressed to the victims back.   Minutes earlier, MIRANDA had stabbed the victim in the right calf.  MIRANDA had taken the knife from the butcher block in the kitchen of the home.  JUAN JESUS ROSARIO had a black colored handgun that he pressed into the victims back and the victim was told if a sound was made they would kill him.  ROSARIO maintained possession of the black handgun and utilized it throughout the event threatening to kill the victim.  The victim pleaded for the actors to leave him alone and that he would not call the police nor would he tell anybody about the incident.

At some point, the victim informed the actors ROSARIO and MIRANDA that there was money inside a vehicle outside in the garage.  The actors took the victim from inside the home into the garage and chased him around a vehicle as they were beating him in the garage.

At some point, the garage door opened and the victim was able to break loose and flee, at which time the actors fled from the scene.

On June 4, 2019, Detective Sergeant David Rodick continued to investigate the incident.

On June 18, 2019, XAVIER MIRANDA was arrested and charged and taken into custody without incident by Detective Sergeant David Rodick at the Luzerne County Adult Probation and Parole Office in Hazleton.
